I make my brother Edward Wayte my sole executor and the legacies above mentioned to be paid by him within the space of 2 years, excepting the legacies to William Mogeridges children which I order to be paid to them as they severally come to the age of 20 or be married and if any of them dies before they come to the age of 20 or marries then their legacy shall go to the rest of the children surviving.

Samuel Waite married Margaret Russell on 26 January 1724 at Leigh, Kent, England, Samuel is "of Penshurst" and Margaret is "of Leigh". They married by licence.1
They lived in Penshurst between 1724 and 1733 as their children were baptised there during that time. It appears that between 1734 and 1741 that Samuel and Margaret lived elsewhere and then returned to Penshurst. A search of surrounding parishes might well turn them up during that period.

On a Datchurst manorial court record dated 7 Oct 1747, the death of Elizabeth Wheatly is noted. Her substantial estate was inherited by Margaret wife of Samuel Wait, Thomas Morley and [blank, but later records show it to be George Hall] still an infant. The properties included a house and lands called Wesbler and Hares and one hundred acres of land in Tunbridge and Leigh, and a barn and 14 acres of land called Kipps Land near Stocks Green, a farm called Dulhams, and a tenement called the Half Moon.2
Samuel Waite died on 11 April 1758 at Leigh, Kent, England, at age 67. Date of death on headstone.

The death of Samuel the Elder is confirmed in the manorial court record of 19 Oct 1758. It is also noted that the Half Moon has been alienated to Thomas Webb.
A later entry on that same date mentions Thomas Waite and George Hall alienating another property, indicating that Thomas was the eldest surviving son (his brother Samuel had died in 1756).2
A gravestone inscription for Samuel Waite was recorded as "Samuel WAITE, died April 11, 1758, aged 69 years.4"

In the Name of God Amen I Thomas Waite of Leigh next Tonbridge in the County of Kent Yeoman being aged and infirm but of a sound and disposing mind memory and understanding praised be almighty God for the same do therefore make and ordain this my last Will and Testament in manner and form following (that is to say) first and principally I resign my soul into the hands of almighty God that

gave it and my Body I commit to the Earth to be decently buried at the discretion of my Executor herein after named and as to the Temporal Estate which it hath pleased Almighty God to bless me with I give devise and dispose thereof as followeth and first I will order and direct that all my Just Debts Legacies Funeral Expences and the probate of this my Will shall be first paid and discharged also I give and bequeath unto my son Edward Waite all my Household Goods and Furniture and all my live stock Cattle Chattels Implements and Personal Effects whatsoever Situate and being on my said Farm in Leigh aforesaid together with the Possession of the said Farm Also I give and bequeath unto my two Daughters Mary Bennet and Ann Cole the sum of thirty pounds a piece of lawful Money of Great Britain Also I Give and Bequeath to my Daughter Elizabeth Seale the sum of five pounds of like Money and I will the said Legacies shall be paid to them respectively at the end of three months next after my decease Also I give and bequeath unto my Grandson Edward Waite son of my said son Edward Waite the sum of Ten Pounds to be paid him by my Executor at his age of twenty one years also I give and devise unto my son Thomas Waite all my Farms Lands and Hereditaments and all my Tythes and Tenths of Corn Grain Hay and other Tythes and Tenths whatsoever situate lying, being, growing and arising within the said parish of Leigh and all other my Lands Hereditaments and Premises where ever they are situate arising and being to hold unto my said Thomas Waite his Heirs and Assigns for ever subject to the payment of the said Legacies given unto my said Daughters and Grandson as aforesaid Also/ After my said Will is so far complyed with what then remains of my Estate as well real as personal that I shall dye possessed of or Interested in I give and bequeath the same unto my said son ThomasWaite his Heirs and assigns and I Nominate Constitute and Appoint my said Son Thomas Waite to be full and sole Executor of this my last Will and Testament hereby revoking and making void all former Wills and Bequests by me at any time heretofore made In Witness whereof I the said Thomas Waite the Testator have to this my last Will and Testament set my hand and seal this twenty fifth day of August in the fifteenth year of the Reign of our Sovereign Lord King George the Third and in the year of our Lord one thousand seven hundred and seventy five. Thomas Waite married Sarah Turner on 29 October 1752 at Sundridge, Kent, England, Thomas of Penshurst; Sarah of Leigh.2
The following burial entry in the Penshurst register was found and thought to be connected to our Thomas and Sarah Waite:
"2 Mar 1763 Sarah wife of Thomas Waite of Tunbridge & dau: of ye above Thos Wickham who coming to assist her father in his illness Sicken’d & died ye day he was buried".
It would have indicated that Thomas and Sarah moved to Tonbridge. The burial entry for her father read "26 Feb 1763 Thomas Wickens in his 60th year".
However, their marriage was subsequently found at Penshurst: 7 Aug 1759 Thomas Waite of Tunbridge and Sarah Wickham of this parish, by licence. Both signed. Witnesses John Browne [usually signs, probably parish clerk], Thomas Wickham.
This marriage occured after the baptism of the child Samuel in 1752 so it must be a different Thomas Waite and not the one on our tree.3
Thomas Waite married Eliza Jackson on 21 February 1759 at Cudham, Kent, England, Thomas of Leigh.2
