    IN THE NAME OF GOD AMEN, I Edward Packham of this parish of Cuckfield in the County of Sussex mason being in good health and of sound mind memory and understanding /praised be God for the same/ do make and ordain this .my last Will and Testament in manner and form following /that is to say/ Whereas I am seized in Fee of a messuage situate lying and being in the Back Lane in this Town of Cuckfield -divided into four separate Dwellings or Tenements and now in the occupation of John Weller, George Loxford, Mary Packham, the widow of my late brother William, and Thomas Fielders with a piece of garden ground thereunto adjoining containing by Estimation about one Rood of Land, more or less abutting on the north to a garden of Sarah Kelsey Widow on the east and west to a Field of the said Sarah Kelsey in the occupation of Michael Sergison Esquire and on the South to a Field of Charles Longford Esquire in the occupation of M….. Rapley the said Garden, being divided, nearly into two equal parts by a Hedge of my own planting running East and West NOW do I give and devise unto my nephew Richard Butcher of the parish of Wivelsfield, mason, and John Marshall of the parish of Hurst, Butcher, the two Dwellings or Tenements which are commonly called or known by the name of the two Upper Houses and are now in the Tenure or Occupation of John Weller and George Loxford above-mentioned. AND ALSO that part of the said Garden which lyeth on the north side of the above mentioned Hedge running East and West being part of the messuage and Garden first above mentioned. AND ALSO the free uninterrupted use Benefit Emolument and Advantage of the Lower Well together with a commodious and convenient passage thereto and therefrom at all times with all the Rights Members and Appurtances to the said two Dwellings or Tenements and to the said part of the Garden in any way belonging or appertaining, TO HAVE AND TO HOLD the premises last mentioned with their appurtances unto the said Richard Butcher and John Marshall and their Heirs upon the Trust and Confidence hereinafter mentioned (that is to say) In Trust for the separate Use and Benefit of my Daughter Sarah the wife of Phillip Gatland of Cuckfield aforesaid Clocksmith for the Term of her natural Life and my Will and meaning is that she shall enjoy the same absolutely free from and in no way subject to the Debts Charges Incumbrances Intermedling or Control whatsoever of her said Husband and from and immediately after her decease in Trust for the use of my Grandaughter Sarah the youngest daughter of the said Phillip and Sarah and her heirs forever ALSO I Give and Devise unto the said Richard Butcher and John Marshall an Annuity or yearly Rent charge often shillings of lawful money of Great Britain to be received taken and to be issuing out of the two Dwellings or Tenements which are called and commonly known by the name of the two lower dwellings or tenements and are now in the tenure or occupation of Mary Packham the widow of my late Brother William and Thomas Fielder above mentioned AND also to be received taken and to be issuing out of that part of the said Garden lying to the South of the said Hedge, running East and West, being the other part of the messuage and garden first above mentioned TO HAVE AND TO HOLD the said Annuity or yearly Rent Charge unto the said Richard Butcher and John Marshall and their Heirs payable by half yearly payments to wit at Lady Day and Michaelmas Day in Trust for the separate use and Benefit of my said Daughter Sarah the wife of Phillip Gatland aforesaid for and during the term of her natural life. And I do desire and direct the same to be paid in the proper hands of my said daughter Sarah whose receipt notwithstanding her coverture shall be a sufficient discharge And I do also authorize and direct my said Trustees and their Heirs to distrain from the same in case the said Annuity or Rent Charge shall be at any time behind or unpaid /Edwd Packham/ and from and immediately after her decease in Trust for the use of my said Grandaughter Sarah and her heirs forever. ALSO I do further give and devise the said two Dwellings or Tenements in the occupation of the said Mary Packham and Thomas Fielder and that part of the said Garden last above mentioned charged and chargeable as aforesaid together with all the rights members and appurtenances thereunto belonging unto my son John Packham for the term of his natural life and from and immediately after his Decease unto Sarah his wife for and during the Term of her natural life if she shall so long so long (sic) a widow and from and immediately after their Decease or the marriage of the said Sarah unto my grandson John Packham the youngest son of the said John and Sarah and his Heirs forever. And I do desire my said Trustees and their Heirs to take into their custody immediately after my decease all the writings in my possession relative to the above mentioned messuage and Garden and to keep them for the Benefit of the persons interested in them. Also I give and devise unto the said Richard Butcher and John Marshall all that Messuage or Tenements in which I now live situate lying and being in or near the Church Yard in the Town of Cuckfield aforesaid and also the garden thereunto belonging and adjoining containing by estimation two Roods of Land more or less abutting on the north to a garden belonging to [blank] Hill Widow and John Marchant on the East to the Vicarage Land on the South to the Land of John Hamner with their and every of their appurtenances TO HAVE AND TO HOLD the said Messuages and Garden with their and every of their appurtenances unto the said Richard Butcher and John Marshall and their Heirs upon the Trust and Confidence hereinafter mentioned /that is to say/ in Trust for the separate use and Benefit of my said daughter Sarah the wife of Phillip Gatland aforesaid for and during the Term of her natural life and my Will and meaning is that she shall enjoy the same absolutely free from and in no way subject to the Debts Charges Incumbrances power Intermeddling or Control whatsoever of her said husband and from and immediately after her Decease in Trust for the use of my Grandaughter Ann the Eldest daughter of the said Phillip and Sarah and her Heirs forever. Also I give and devise all that workshop situate lying and being opposite to the Hound Inn in the Town of Cuckfield aforesaid in the occupation of John Curteis and now used and employed by him in his Business of a Tallow Chandler And also the garden thereunto belonging and adjoining containing by estimation one Rood of Land more or less and also a small Tenement adjoining to the said Garden likewise in the occupation of the said John Curteis and used as a workhouse unto my said son John Packham for and during the term of his natural life and from and from and after his Decease unto his said wife Sarah for and during the term of her natural life if she shall continue so long a widow and from and immediately after their decease or the marriage of the said Sarah unto my Grandson Ned the eldest son of the said John and Sarah and his Heirs forever. Also I give and bequeath unto my son John Packham all my working tools of what kind soever and wheresoever and all my woollen apparel. Also I give full power unto my said Daughter Sarah the wife of Phillip Gatland aforesaid to take for her own separate use and benefit but in no way subject to the intermeddling of her said husband any part of my Goods and Linen (the Working Tools and Woollen apparel excepted) that she shall think proper provided that what is taken in the whole does not amount in value to more than the sum of Ten pounds And after payment of all my just debts the expenses of my Funeral and of proving this my Will I give and bequeath the Residue of my personal estate of what kindsoever and wheresoever to my Grandaughter Sarah the youngest daughter of the said Phillip and Sarah to be paid to my Grandaughter Sarah by my Executor hereinafter named when she shall attain her age of Twenty one years /Edwd Packham/ And I do desire and direct my said Executor in the mean time to convert the same into ready money as soon as conveniently may be after my Decease and after taking thereout as much as may be necessary for the putting my said Grandaughter Sarah apprentice to a Mantua Maker to place the remainder out upon Bond or other Security at the Direction of my Executor. And I do appoint the said Richard Butcher my Nephew sole Executor of this my Will. Sole Executor of this my Will. IN WITNESS whereof I the said Edward Packham have to this my last will and Testament contained in three sheets of paper set my hand and seal this eight day of March one thousand seven hundred and seventy six Edwd Packham Signed Sealed published and Declared by the said Edward Packham the Testator as and for his last Will and Testament in the presence of us who were present at the signing and sealing thereof John Haynes Peter Elliott, servants to Mr Campion John Johnson servant to Mr Courthope.
    The Will of Edward Packham late of Cuckfield within the Archdeaconry of Lewes Mason deceased was proved the twenty second Day of March in the year of our Lord one thousand seven hundred and eighty three Before the Reverend Peter Guerin Crofts Clerk Surrogate and so forth Upon the Oath of John Butcher the sole Executor in the said will named to whom was committed the Administration of the Goods he being first sworn
