It does not appear that John Elliott’s will has survived nor was submitted for probate. A grant of administration over his estate was made on 17 June 1640. However, a lot of detail regarding his will and his estate is documented in the Rotherfield manorial court records.
This information was taken from the English handwritten transcription of the Rotherfield manorial court records made by Catharine Pullein in the 1920s. They are in six volumes and have been deposited at The Keep. The reference is: ESRO: PAR 465/26/1/1-6 and it is useful to know that they have been indexed (people names and property names) at the back of each volume.
Rotherfield Manorial Court Baron: 12 October 1639
[This is John Elliott, probably near death, surrendering his properties to the manorial court for him to have use of the properties while he lives and then, upon his death, for the court to transfer them according to his last will and testament. This was the way properties held of a lord/lady of the manor, could be transferred by will]
They present that John Elliott out of court since last court viz June 11 last past & by acceptance of Walter Lusted, bedell & in presence of Wm Allen & Thos Weston, two customary tenants, a messuage with buildings & gardens etc. [ … a long list of properties follows…] To use of the said John Elliott for the term of his natural life & after his decease to use of the last will & testament of the said John … for such uses & interests & such ways & forms as the said John in his last testament & will shall ……. declare & for default of such will or limitations then to the use of the right heirs of the said John Elliott for ever. Comes the said John Elliott & prays etc. Fine 40/-.
Rotherfield Manorial Court Baron: 27 October 1639
[John Elliott, the father, has now died and his son John inherits. There is a John Elliott burial at Rotherfield St Denys on 5 March 1640 and 25 Aug 1640 but neither fits. The dates given in the manorial records imply that he died between 12 and 27 Oct 1639. Note at this time Rotherfield has a lady of the manor.]
The homage present that John Elliott gent. who held to him & his heirs various lands & tenements of assart afterwards mentioned died so seised after whose death there falls to the lord for heriot an ox worth £6 which is delivered to the lady’s store and that John Elliott is his eldest son & next heir to the premises & of full age.
Comes John Elliott the son & prays admittance to two pieces of land called Newe Reede & Oulde Reede containg by estimation 7 ½ acres held by the rent of 22 ½ d lying next Anthony’s Reede & to a cottage & 2 crofts called Anthony’s Reede (except two acres there formerly sold to Nicholas Millington & to a croft called Shepecotes, land called Rookes Innain [Innam?] alias Hothcroft containing in all by estimation 10 & 9 acres with appurtenances held by rent of 4/9 of which the said J.E. senr died seised which the lady, etc
Comes John Elliott & prays admittance to a piece of assart land of Crowburrowe [Crowborough] called Whitefield containing 5 acres in Rotherfield lying with the highway leading from Brookesharne [Thornbrooke] to Crowburrowe on the East & the land of the said John on S.W. & N. of which the said John Elliott senr died seised which the lady etc.
Comes John Elliott & prays admittance to all those parcels of land called Jackhodges containing by estimation 30 acres. Also to two similar parcels called le nyne acres & le tenne acres containing by estimation 20 acres in Rotherfield of which John Elliott senr died seised which the lady, etc. [ …….. .and there is more, a long list of properties]
Subsequently, John Elliott, the son, applies for administration of the estate:

[This would appear to be the court dispensing properties according to John Elliott’s will. It includes an excerpt from the will.]
They present that John Elliott who held to him & his heirs a messuage, barn with garden & 6 parcels of land of assart of Frant containing 16 acres formerly in occupation of John Pococke by the yearly rent of 4/4 ½ (except a cottage & garden & one little parcel adjoining containing ½ acre formerly in occupation of John Gorringe) since last court died siesed and that Obadiah Elliott is eldest brother & next heir. And on 1st proclamation comes said Obadiah Elliott & prays [admittance], etc. Relief 4/4 ½ etc.
Obadiah Elliott also admitted to another messuage, barn & garden & assart land containing 10 acres at Crowburrowe [Crowborough] by the yearly rent of 21d & other services. Relief 21d.
After the death of said John Elliott there falls to the lady a heriot an ox worth £6.10 and the lady has sold the said ox for £6 10 her payment.
They present that the said John Elliott in his lifetime surrendered a messuage & divers lands & tenements to the use of his last testament & will as appears by presentation of the homage at the court held 12 Oct last past by which last will by said John Elliott inscribed, bearing date June 11 15th year Charles, willed & bequeathed the said messuages & premises with appurtenances as follows in his English words viz: “I doe hereby give & devise & will limit & appoint & declare all the said messuage land tenements whatsoever by me surrendered (as aforesaid) unto my said loving brother Alexander Elliott & to his heirs & assignes for ever” as by the said testament & will here in court shown plainly apparent. And upon this comes the said Alexander Elliott & prays admittance etc (as at court Oct 12, 1639). Fine £100

Notes:
The above process of surrending properties to the manorial court “to the use of a last will & testament” was only necessary for properties held of the manor (i.e.copyhold property) and not freehold property. Given the large number of properties held by John Elliott it is likely he held some others freehold, which, given the will was not presented for probate, would likely have passed to John, his eldest son & heir, if he had not dealt with them already before his death. - Death*: John Elliott died before 27 October 1639 at Rotherfield, Sussex, EnglandB. (as per manorial court records 27 Oct 1639).
