consideration of their taking upon them the Executorship of this my Will Also I give devise and bequeath unto my said Wife Elizabeth Ashdown and her Assigns for and during the Term of her natural life All that my Freehold Messuage or Tenement Stable Buildings and Garden situate in Heathfield aforesaid now in the occupation of myself and Mrs Elizabeth Oxley and by me lately purchased of Mr Samuel Baker And also all that piece or parcel of Freehold Land containing by estimation one acre and an half more or less situate near the Church in Heathfield aforesaid now in my own occupation and formerly belonging to Mr Thomas Rhoades And also all that my Customary Cottage Buildings Garden Orchard Land and Hereditaments situate in Heathfield aforesaid and holden of the Manor of Sapperton now in the occupation of myself and James Haffenden And also all other my Real Estate whatsoever and wheresoever To hold the same and every part thereof with their and every of their Rights Members and Appurtenances unto her my said Wife Elizabeth Ashdown and her Assigns for and during the Term of her natural life And immediately after the decease of her my said Wife Elizabeth Ashdown I give devise absolutely dispose of the said Freehold and Customary Hereditaments and Real Estate so devised to them as aforesaid with the Appurtenances either together or in parcels by public Sale or Auction or by private contract or in such other manner and to such person or persons and for such price and prices sum and sums of money as to them or the Survivor of them or his Heirs shall seem reasonable and most beneficial to the Trusts hereinafter mentioned And upon payment of the money for which the said Hereditaments and premises or any part thereof shall be sold to convey surrender and assure the Hereditaments and premises so to be sold to the purchaser or purchasers thereof and his her or their Heirs and Assigns and to give one or more Receipt or Receipts for the money for which the same shall be sold which Receipt or Receipts shall be a good and sufficient discharge or good and sufficient discharges to any purchaser or purchasers for the money for which the same shall be sold or for as much thereof as in such Receipt or Receipts shall be expressed or acknowledged to be received and such Purchaser of Purchasers and his her or their Heirs or Assigns shall not afterwards be obliged to see to the application or be answerable or accountable for any loss misapplication or nonapplication of the said purchase monies or any part thereof And I direct that all the clear monies to arise and be received by and from the sales and disposal of the said Hereditaments and Real Estate hereinbefore devised and bequeathed upon Trust for Sale as aforesaid and from the rents and profits thereof in the meantime and until such Sale and Sales (the incidental charges and expences being thereout first deducted) shall fall into and constitute a part of the Residue of my personal Estate and shall be paid and applied accordingly Also I give and bequeath unto the said John Baker and John Huggett the Younger their Executors Administrators and Assigns All the Rest Residue and Reminder of my ready money and Securities for money Monies in the public stocks or Funds Debts Effects and personal Estate whatsoever and wheresoever (not hereinbefore otherwise disposed of) To hold the same and every part thereof unto them the said John Baker and John Huggett the Younger their Executors Administrators and Assigns Upon trust that they or the Survivor of them his Executors or Administrators shall and do as soon as the same shall have been collected and received and according as the same shall fall in to their hands by either of the Trusts aforesaid divide the same into eight equal parts or shares and pay one equal eighth part or share thereof unto and equally between all the Children of my said late Brother Thomas Ashdown deceased one other equal eighth part or share thereof to my said Brother William Ashdown one other equal eighth part or share thereof to my said Brother George Ashdown one other equal eighth part or share thereof to my said Sister Mary Gilbert one other equal eighth part or share thereof to my said Sister Sarah Huggett one other equal eighth part or share thereof to my said Sister Elizabeth Russell one other equal eighth part or share thereof to my said Sister Martha Haffenden and the remaining equal eighth part or share thereof unto my said Sister Fanny Knight and which said several eight parts or shares of the said Residue of my said personal Estate I do hereby bequeath unto the said several parties in manner aforesaid accordingly And my Will and mind further is that my said Trustees and Executors or either of them their or either of their Heirs Executors or Administrators shall not be charged and chargeable with or be answerable or accountable for any more of the aforesaid Trust estates Monies and premises than they shall respectively actually receive or shall come to their respective hands by virtue of this my Will notwithstanding either or them may sign or give or join or concur in signing or giving any Receipt or Receipts for the sake of conformity nor with or for any loss which shall happen in placing out all or any of the trust monies aforesaid or of any security or securities as aforesaid or by the deficiency or insufficiency arising by depositing all or any of the said Trust monies in any Bank or in any Bankers Hands or elsewhere for safe custody or otherwise or with or for any loss which shall happen of the aforesaid Trust Monies and premises or any part thereof so as such loss happens without their or either of their wilful neglect or default nor the one for the other of them or for the Acts Deeds Receipts Defaults or Disbursements of the other of them And also that it shall and may be lawful for them my said Trustees and Executors respectively by and out of the said Trust estates Monies and premises to deduct retain and reimburse to themselves and himself and to allow to each other all such losses costs charges damages and expences as they shall respectively bear pay sustain or be put unto by reason of this my Will or in performance of the Trusts aforesaid or otherwise relating thereto Together with a reasonable allowance for their Journies trouble and loss of time in and about the same And I do hereby make nominate constitute and appoint the said John Baker and John Huggett the Younger joint executors of this my Will and do hereby revoke all former Wills and codicils by me made In Witness whereof I the said James Ashdown the Testator have to this my last Will and Testament contained in this and the three preceding sheets of Paper set my Hand and Seal (to wit) my hand to the
