This is the last will and testament of me Thomas Packham of Leigh Place in the parish of Cuckfield in the county of Sussex Yeoman as follows First I will order and direct that all my just debts funeral and testamentary expenses be fully paid and satisfied by my executors hereinafter named as soon as conveniently may be after my decease I give and bequeath unto my nephews John Packham of Pains Place in the parish of Cuckfield aforesaid Yeoman and Charles Packham of Hurstpierpoint in the said county of Sussex Miller all and every my personal estate and effects whatsoever and wheresoever and of what nature or kind soever which I may die possessed of interested in or entitled unto in possession reversion remainder or expectancy or otherwise howsoever In Trust that they the said John Packham and Charles Packham or the survivor of them his executors or administrators do and shall carry on the farming business on the lands which shall be in my occupation at the time of my decease for and during the natural life of my dear wife Mary Packham or until the lease or respective leases under which I hold such lands shall expire by effluxion of time and do and shall pay and apply the interest proceeds and profits of the said farming business and of all other my personal estate and effects for and towards the support and maintenance of my said wife Mary Packham for and during the term of her natural life and from and immediately after her decease or the expiration of the said lease or leases which shall first happen In Trust that they the said John Packham and Charles Packham or the survivor of them his executors or administrators do and shall so soon as conveniently maybe sell and convert such part and parts of my said personal estate and effects as shall not consist of monies into money and call in and receive all such sum and sums of money as shall be due and owing to my said estate from any person or persons whomsoever upon any security or securities account or accounts whatsoever and the money thereby arising after deducting thereout the costs charges and expenses attending such sale and the performance of the trusts hereby in them reposed In Trust to divide the same into six equal parts and pay 1/6 part thereof unto my son Thomas Packham one other 6th part thereof unto my son William Packham one other 6th part thereof unto my son Henry Packham one other 6th part thereof unto my daughter Sarah Packham and one other 6th part thereof unto my daughter Elizabeth the wife of Thomas Oram of Cuckfield aforesaid labourer and the remaining six part thereof In Trust that they the said John Packham and Charles Packham or the survivor of them his executors or administrators do and shall lay out and invest the same in their or his own name or names in the public stocks or funds or on government or real securities at interest to be from time to time called in altered varied and transposed by them as occasion shall require in which case the receipt or receipts of my said trustees or of the survivor of them his executors or administrators shall be a good and sufficient discharge or good and sufficient discharges for so much of the said money so //
called in as shall be therein expressed or acknowledged to be received and the person or persons paying in the same his her or their heirs executors and administrators shall not afterwards be obliged to see to the application thereof or be answerable or accountable for any loss misapplication or nonapplication thereof respectively And upon further trust that they my said trustees or the survivor of them his executors or administrators do and shall pay the dividends interest and annual produce of the said trust monies so directed to be laid out and invested as aforesaid unto my daughter Anne the wife of Robert Hodd during the term of her natural life separate and apart from her present or any after taken husband and without being subject or liable to his control debts or engagements And I do hereby direct that the receipt or receipts of my said daughter shall notwithstanding her coverture be a good and sufficient discharge or good and sufficient discharges to my said trustees for so much of the said dividends interest and annual produce as shall be therein expressed or acknowledged to be received And from and immediately after the decease of my said daughter Ann Hodd upon further trust that they the said John Packham and Charles Packham or the survivor of them his executors or administrators do an shall pay and equally divide the money so to be laid out and invested as aforesaid and the dividends which shall be then due and owing thereon unto and amongst all and every the child and children of my said daughter Ann Hodd whether born in lawful wedlock or not and their legal personal representatives share and share alike Provided always and my will an mind is that in case the lease or respective leases under which I hold the lands in my occupation shall expire in the lifetime of my said wife Mary Packham that no division of my estate and effects shall be made amongst my children but the whole interest dividends and proceeds arising therefrom shall be paid to my said wife Mary Packham during her natural life anything hereinbefore contained to the contrary thereof notwithstanding And I do hereby nominate constitute and appoint the said John Packham and Charles Packham joint executors of this my will and I do hereby declare my will and mind to be that my said trustees and executors or either of them their or either of their heirs executors or administrators shall be charged and chargeable only for such monies as they shall respectively actually receive by virtue of the trusts hereby in them reposed nor shall they nor either of them be at any time answerable or accountable for any banker broker or other person with whom or in whose custody or hands any part of the said trust monies shall or may be deposited or lodged for safe custody or otherwise in the execution of the Trusts hereinbefore mentioned nor shall they or either of them be at any time answerable or accountable for the insufficiency or deficiency of any security or securities stocks or funds in or upon which the said trust monies or any part thereof shall be placed out or invested nor for any other loss which may happen to the aforesaid trust premises except the same shall happen by or through their own wilful default respectively and that one of them shall not be answerable or accountable for the other of them nor for the acts deeds defaults receipts or //
