    In the name of God Amen I John Aker of the town and Port of Hastings in the county of Sussex Blacksmith do make publish and declare my last will and testament in manner and form following (that is to say) first I will and direct that after my just debts funeral expenses and the charges of proving and establishing will my will be fully paid and discharged by my executors hereinafter named and I do hereby charge my real and personal estate with the payment thereof accordingly and subject thereto I give and bequeath unto my dear wife Elizabeth all my household goods and furniture plate linen and china which shall happen to be in and about my dwelling house at the time of my decease to and for her own use absolutely and for ever Also I give an devise unto my said wife Elizabeth all that my message or tenement with the Blacksmith shops and premises situate in the parish of St Clement in the town of Port aforesaid and now in my own occupation To hold to her my said wife Elizabeth and her assigns for and during the term of her natural life without impeachment of or for any manner of waste and from and immediately after her decease I give and devise the same premises and every part thereof unto and amongst all and every such child and children as well daughters as sons as I may happen to have at the time of my decease or that shall be born within a reasonable time afterwards equally to be divided between them share and share alike as tenants in common and not as joint tenants and to their several and respective heirs and assigns absolutely and for ever And in case any or either of my said children shall happen to depart this life in my life time or in the life time of my said wife or before he she or they shall severally have attained the age of twenty one years without leaving any issue of his her or their body or bodies lawfully begotten then I give and devise the part share of him her or them so dying as aforesaid unto the survivors and survivor of my said children if more than one equally share and share alike as tenants in common and not as joint tenants, and to their survivor and respective heirs and assigns and if but one them to such one his or her heir and assigns. But in case and or either of my said children shall happen to depart this life in my life time or in the life time of my said wife or before her she or they shall severally have attained the age of twenty one years before lawful issue of his her or their body or bodies begotten then in such case I give and devise the part or share of him her or them so dying as aforesaid until such child or Thomas Thwaites the Younger of Hastings aforesaid sailmaker and William Smith of the same place carpenter all and singular my stock in trade and all other my personal estate and effects of what nature or kindsoever the same may not be hereinbefore otherwise disposed of to hold the same until the said Thomas Thwaites and William Smith and the survivor of them and the executors and administrators of such survivor upon the trusts and to and for the ends interests and purposes hereinafter mentioned and expressed of and concerning the same (that is the say) upon Trust that the said Thomas Thwaites and William Smith or the survivor of them or the executors or administrators of such survivor do and shall as soon as conveniently may be after by decease make sale and dispose of such part of my personal estate as may be liable at and for the best prices and prices which can be reasonably had or gotten for the same either by public sale or private contract at once or at several times and together or sell lots or parcels as they shall deem most prudent and the money arising by sale thereof together with my other personal estate (after payment of my just debts and the mortgages if any) which may happen to be on my said house and premises and also my funeral and testamentary expenses to place out at interest on government or some real security in his or his own names or name and John Thwaites and William Smith or the survivor of them his executors or administrators shall and do well and truly pay the interest and dividends of such principal money until my said wife Elizabeth and her assigns or permit and suffer her or them to receive the same for and during the time of her natural life for and towards the maintenance of herself and the children that I may happen to have a the time of my decease or that shall be born within a reasonable time afterwards and from and immediately after the decease of my said wife Elizabeth upon trust to pay and divide to transfer the said principal money so to be placed out at interest onto and equally between all and every such child and children as well daughters as sons as I may happen to have at the time of my decease or that shall be born within a reasonable time afterwards when and as they shall respectively attaching the age of twenty one years to and for their own use and benefit absolutely and I hereby given and bequeath the same to them accordingly and in case of the death of my said wife before my said children respectively shall have attained the age of twenty one years I do hereby direct my said trustees and the survivor of them his executors and administrators to pay an apply the interest and dividends of each Childs share of the said principal money for and towards his or her or their maintenance education and support until such time as he she or they shall have respectively attached that age and I do hereby also expressly declare it to be my intention that in the case of any or either of my said children shall happen to depart this life before he she or they shall have attained the age of twenty one years leaving lawful issue of his other or their body or bodies begotten that my said trustees or the survivor of them or the executors and administrators of such survivor should pay and divide or transfer part or share of him her or them so dying as aforesaid unto such child or children if more than one equally share and share alike and if but one then to such only one it being my intent ion that the issue of any deceased child should enjoy the full benefit by this my will intended for the father or mother but in case any or either of my said children shall depart this life in my life time or in the life time of my said wife or before she or they shall severally have attained the age of twenty one years and without leaving any issue of his her or their body or bodies lawfully begotten then and in such case I do hereby direct my said trustee and the survivor of them and the executors or administrators of such survivor to pay and divide or transfer the part or share of him her or them so dying as last aforesaid unto the survivors and survivor of my said children if more than one equally share and share alike upon their severally attaining their respective ages of twenty one yeas as aforesaid and if but one should survive then to such only one upon his or her attaining that age and in case all my said children shall happen to die in the life time of my said wife without leaving any lawful issue of his her or their body or bodies then and in such case I do hereby direct my said trustees and the survivor of them and the executors and administrators of such survivor to pay or transfer the whole of the said principal money unto my said wife Elizabeth for her own use and benefit absolutely and for ever and I do hereby give and bequeath the same to her accordingly provided always and I do hereby further declare my will and meaning to be that my said trustees and the survivor of them his executors and administrators shall be charged and chargeable only for such and so much money and they and each of them shall respectively actually receive by virtue of or under the trusts of this my will and that one of them shall not be answerable or accountable to the other of them or that the acts deeds or receipts of the other of them but each for his own acts and deeds only nor for the insufficiency or deficiency of any security or securities or rise or fall of any stocks or xxxx in or upon which such principal money or any part thereof shall or may be placed out or invested nor for any other loss misfortune or damage which may happen in the execution of any of the trusts of this my will or in relation thereto except the same shall happen by or through their or either of their own wilful defaults respectively and also that they my said trustees and the survivor of them and their heirs executors and administrators of such survivor shall and lawfully may with and out of the money which shall come to their hands by virtue of or under the trust to his my will retain to and reimburse himself and themselves respectively all such loss costs charges damages and expenses which they or either or them shall or may suffer sustain expend disburse or be put unto by reason or means or on account of the trusts by this my will in them reposed or in about touching concerning the management or execution thereof and I do hereby nominate constitute and appoint the said Thomas Thwaites and William Smith executors or this my last will and testament and together and along with my said wife guardian of my said children during their respective minorities and I do give and bequeath unto each of them my said trustees a mourning ring as a small acknowledgment for the trouble they may have in the execution of the trusts of this my will over and above and exclusive of their reasonable charges and expenses and lastly I do hereby revoke     In the name of God Amen the one and twentith day of October in the yeare of our Lord God One Thousand Six Hundred Fiftie and Two I John Acurst of Beckly in the Countie of Sussex husbandman beinge weake in Bodie but of good and perfect memorie for the which I give prayer and thanks unto Almightie God doe make and ordaine this my last will and testament in manner and forme followinge That is to say, first and principally I commend my Soule unto the hands of Almightie God my maker and Creator who att the first gave itt to me in full assurance through the death and sufferings of my Saviour and Redeemer Jesus Christ to be raysed to everlasting life and to have an inheritance with the Saints in glory and my bodie to the earth from whence it came to be interred at the discretion of my Executrix hereafter named after decent manner in Christian burial, /Item/ I give and bequeath unto my Three Brethren William, Thomas and Richard to either of them one shilling to be paid unto them by my Executrix within six moneths after my decease /Item/ I give and bequeath unto Thomas Acust sonn of my brother William Acust aforesaid five pounds to be payd by my Executrix into the hands of Richard Humphrey of Beckley aforesaid within six months after my decease and their to remayne untill the said Thomas Acust shall attaine unto his respective age of one and twenty years att which time my will is that the said Richard Humphery shall pay unto the said Thomas Acust the said some of Five pounds and also profit for itt for the time it hath bine in his hands after the rates of Twelve pence in the pound. There are no other Akehursts or variants in the Beckley burial register. It is likely that this is a mistranscription and should be 23 Nov 1652.2
