    Judgment for the plaintiff was de
    livered by the Chief Justice (Sir John
    Northmore), yesterday, in a Supreme
    Court action in which special and general
    damages were claimed by Percival James
    Clegg, a jobbing contractor, from the
    Commonwealth of Australia. Mr. L. W.
    Jackson (instructed by Jackson, McDon
    ald, Connor and Ambrose), appeared for
    the plaintiff, and Mr. N. P. Lappin and
    Mr. H. V. Reilly (Dwyer and Thomas),
    for the defendant.
    The claim arose from a collision be
    tween Clegg's motor car and a motor van
    driven by Arthur Frederick Jenkin, an
    employee of the Postmaster-General's
    Department, at the intersection of Bar
    ker-road and Axon-street, Sublaco, onFix this text
    the afternoon of December 19 last. Clegg
    was severely injured in the collision,
    which each driver alleged was due to
    negligence on the part of the other. The
    defendant counterclaimed £27/8/8 on
    account of damage caused to the motor
    van.
    Giving judgment for the plaintiff on
    the claim and counter-claim, with costs
    ip each instance, the Chief Justice held
    that the accident resulted entirely from
    the negligence of the defendant's em
    ployee. His Honour said that Jenkin had
    blown his horn when some little distance
    from the intersection, and then-being
    apparently under the impression that this
    blowing would blow everyone else out of
    his way-had entered on the intersection
    at a pace which, in the circumstances,
    was excessive. The plaintiff would be
    awarded £73/6/ special damages and
    £150 general damages.1
