    In the Name of God Amen I Samuel Washer of the parish of Heighton in the County of Sussex yeoman do make and publish this my last Will and Testament in manner following that is to say
    First I will that all my Just Debts be Duly truly and fully paid Satisfied and Discharged
    Also I Give Devise and Bequeath unto my Eldest Son Samuel all that my Freehold Messuage or Tenement Scituate lying and being in the parish of Denton in the said County of Sussex and all other my Freehold Lands whatsoever in the sd parish of Denton To Have and to Hold the same premises and Every part thereof with their and Every of their appurtenances unto my said Son Samuel for and During the Term of his natural Life without Impeachment of or for any manner of waste And if the said Estate so Given and Devised to my said Son shall Determine during the Life of my said Son Then from and after Such Determination thereof My Will is that the same premises and Every part thereof shall remain unto Cornelius Humphery of Newhaven in the County aforesaid Gentleman and my youngest Son John Washer and the Survivor of them and the Heirs and Assigns of Such Survivor for and During the Natural Life of my said Son Samuel In Trust to Support and preserve the Contingent Remainders herein after Limited and appointed from being destroyed and Defeated and for that purpose to make Entries as occasion shall require Nevertheless to permit and Suffer my said Son Samuel to have and take to his own use the Rents and profits of the said premises and Every part thereof During the said Term of his Natural Life And from and after the Death of my said son Samuel I Give Devise and Bequeath the same premises and Every part thereof Unto the Right Heir of the body of my said Son Samuel and the Heirs of the Body of Such Right Heir Lawfully Issuing
    And Whereas The Dean and Chapter of the Cathedral Church of the Holy Trinity of Chichester by an Indenture made between The said Dean and Chapter of the one part and my late Brother William Washer now Deceased of the other part Bearing Date the Second Day of May One Thousand Seven Hundred and Thirty Nine Demised Granted and to Farm Lett unto my said late Brother all that Barn and all those Several parcells of Land thereunto belonging with the appurtenances called Nores Scituate lying and being in Heighton Denton and Michin in the said County of Sussex All which premises last mentioned are particularly described and Specifyed in a Terrar or Survey Indorsed on the Same Indenture To Have and to Hold the Same to my said late Brother his Executors Administrators and Assigns from the Feast of the Annunciation of the Blessed Mary last past before the Date of the said Indenture for During and unto the full End and Term of One and Twenty years from thenceforth next Ensuing fully to be Compleat and Ended By virtue of which Demise my said late Brother in his Lifetime Enter’d into the said Demised premises and was possessed thereof and being so possessed thereof my said late Brother Died a Batchelor and Intestate after whose Death Administration of All and Singular the Goods and Chattels Rights and Credits which were my said Late Brother’s at the time of his Death was duly Committed to me and to my Brother Thomas Washer of Seaford in the County aforesaid as being the only Brothers and next of Kin to my said Brother Deceased (my said Late Brother Leaving no Father or Mother or any other Brother or Sister or any other Representative of them) In pursuance whereof all the said Goods Chattels Rights Credits and personal Estate of my said Brother deceased have been fully administer’d and all his just Debts and funeral Expenses Duly and Truly paid Satisfied and Discharged and thereby and by force of the Statute for the Better Distribution of Intestates Estates One Undivided Moiety or Half part or Share of the said Demised premises for and during the Remainder of the said Term so demised as aforesaid doth belong and appertain unto me Now my Will is and I do hereby Give Devise and Bequeath all that my said Undivided Moiety or Half part or Share and all my Estate Right Title Interest Benefit profit property Claim and Demand of in to from out of and upon the said Term and premises so demised as aforesaid and Every or any part thereof unto the abovenamed Cornelius Humphery and my said Son John Washer and the Survivor of them and the Executors and Administrators and Assigns of Such Survivor upon This Special Trust and Confidence notwithstanding That they the said Cornelius Humphery and John Washer and the Survivor of them and the Executors Administrators or Assigns of Such Survivor shall permit and Suffer my said Son Samuel to have and take to his own use the Rents Issues and profits of the said Undivided Moiety and premises last mentioned for and During his Natural Life Upon this Condition Nevertheless that my said Son Samuel shall and do yearly and Every year During his Natural Life yield and pay unto the said Dean and Chapter his proper and Due proportion part of Share of all and Every such Rent or Rents Summe or Summes of money and Every other thing or things whatsoever which by the said Lease and reserved and made payable At all and Every such time or times as the same shall become due and payable by Virtue of the said Lease And upon this further Condition likewise that upon Every Renewal of the said Lease at any time or times when such Leases are usually renewed (and I do hereby desire and request the said Cornelius Humphery and John Washer and the Survivor of them and the Executors Administrators and assigns of such Survivor That they or Some or One of them will Endeavour to have the said Lease renewed at all and Every such usual time or times and will have the same renewed accordingly) My said Son Samuel shall and do justly and duly pay and satisfy to the said Dean and Chapter and Every other person or persons whatsoever to whom the same shall be due and payable one Half part or Share of all and Every Fine or Fines Summe or Summes of money which by the said Dean and Chapter shall be Lawfully Demanded for Such Renewal and of all other Costs Charges and Expences whatsoever happening and arising upon such Renewall And Upon this further Special Trust and Confidence that from and after the Death of my said Son Samuel or (if my said Son Samuel shall be Guilty of any Breach of any of the Conditions beforementioned) from and after Such his Default therein They the said Cornelius Humphery and John Washer or the Survivor of them or the Executors Administrators or Assigns of such Survivor shall Sell and Dispose of the said Undivided Moiety and premises last mentioned for the best price that can be got for the same and the money arising from such Sale thereof shall divide and Distribute amongst all the Children of my said Son Samuel that shall be living at the time of his Death or at the time of such his default as aforesaid Respectively by Even and Equal Shares and portions And I do likewise Give and Bequeath unto my said Son Samuel Two Hundred and fifty pounds in money to be paid him within Six months after my Decease Also I Give Devise and Bequeath unto my said Son John Washer and his Heirs for Ever all that my Copyhold or Customary Messuage or Tenement Scituate in Bletchington in the said County of Sussex together with the Yard Garden and Appurtenances thereunto belonging or appertaining And Also all that Barn Garden Lands and Hereditaments with the appurtenances containing by Estimation forty and five acres more of Less Scituate Lying and being in the said parish of Bletchington (late the Estate of my said Brother William Washer Deceased) and all Commons Common of pasture for Oxen Sheep and other Beasts to the said Lands and premises last mentioned or any part thereof belonging or therewith now or heretofore Letten Used Occupied or Enjoyed or accepted reputed Deemed or taken to be as part parcell or member thereof and also all other my Freehold Lands and Estate whatsoever Scituate at Bletchington aforesaid Also I Give Devise and Bequeath unto my Daughter Mary and her Heirs for Ever all that my Freehold Messuage or Tenement Scituate Lying and being at Heighton aforesaid together with the Stable Garden and Croft thereunto belonging and all other my Freehold Estate whatsoever at Heighton aforesaid Also I Give Devise and Bequeath unto my Two Daughters Katherine now the wife of William Clever and Anne now the wife of Robert Beane The Several Summes of One Hundred pounds a piece To be paid to them Severally within Six months after my Decease Also I Give Devise and Bequeath to my abovementioned Daughter Mary and to my Daughter Elizabeth the Several Summes of One Hundred and fifty pounds a piece To be paid to them immediately after my Decease and in Case it shall so Happen That my Executor herein after named shall not immediately upon my Decease be able to pay the said Two Legacies or Summes of money last mentioned Then my Will is that my said Executor shall pay to Each of my said Two Daughters last mentioned Interest for the said Severall Legacies or Summes of money so Devised to them as aforesaid after the Rate of five pounds for One Hundred pounds by the year Untill their said Legacies shall be respectively paid to them And I do likewise Give and Bequeath to my said Two Daughters last mentioned all my Household Goods and Furniture whereof I shall be possessed at the time of my Death Equally to be divided between them Also I Give Devise and Bequeath unto my Two Grandchildren John Cleaver and Mary Cleaver Children of my late Daughter Susannah who is now deceased The Several Summes of fifty pounds a Piece To be paid to them severally in manner following That is to say To my said Grandson John Cleaver when He shall arrive at the Age of One and Twenty Years And to my said Grand-Daughter Mary Cleaver when she shall arrive at the Age of One and Twenty Years or on her Day or Marriage which shall first happen And my Will is further that for and towards the Educating and Bringing up of my said two Grandchildren my said Executor shall pay or Cause to be paid to Each of my said Two Grandchildren yearly and Every year Untill their respective Legacies shall become due and payable the Summe of Forty Shillings by four Even and Equall Quarterly payments And if Either of my said Two Grandchildren shall die before the time when his or her respective Legacy shall become due and payable Then My Will is that the Legacy of him or her so dying shall go to the Survivor of them and shall be paid to Such Survivor in manner as before Directed That is to Say to my said Grand Son if he Survive at his Age of One and Twenty years or to my Said Grand Daughter if she Survive at her Age of One and Twenty years or Day of Marriage which shall first happen And my Will is further that upon the Death of Either of my said Grandchildren my said Executor shall pay to the Survivor of them yearly and Every year untill the Legacy or Legacies of him or her so Surviving shall become due and payable The Summe of four pounds by Like Quarterly payments and If Both my said Grandchildren shall happen to die before the time or times above appointed for the payment of their Respective Legacies Then my will is the said Two Legacies so given and devised to my said Grandchildren as aforesaid shall go to and be Equally Divided between Such of my Children as shall be Living at the time of my Death Also I Give and Bequeath unto Cornelius Humphery beforementioned One Gold Mourning Ring of the price and value of One and Twenty Shillings And As to all the Rest Residue and Remainder of my Estate Whatsoever I give Devise and Bequeath the Same unto my said son John Washer and I do make Constitute and appoint my said Son John Washer Sole Executor of this my Last Will and Testament Hereby revoking and repealing all former and other Wills by me at any time heretofore made In Witness whereof I have to this my said last Will and Testament written on four Sheets of paper and to Each Sheet thereof Set my Hand and Seal this Twelfth day of September in the year of Our Lord One Thousand Seven Hundred and Forty Two

    In the Name of God Amen I Samuel Washer of Chailey in the County of Sussex Yeoman being indisposed in Bodily Health but of Sound Mind and Memory praised be Almighty God therefore Do make and ordain this my last Will and testament in manner and form following (that is to say) First and principally I resigne my Soul into the hands of Almighty God my Creator trusting in and through the Merits Death and Passion of Jesus Christ my Blessed Saviour and Redeemer to obtain full pardon and Remission of all my Sins and my Body I commit to the Earth to be decently Interred at the Discretion of my Executrix herein after named And as to the Temporal Estate wherewith it hath pleased Almighty God to bless me I dispose thereof as followeth First I Give and bequeath unto my Loving Wife Goodgift the use of all and Singular my Goods Chattells Personal Estate and Effects whatsoever and wheresoever (after my just Debts Funeral Expences and the Costs of proving this my Will are thereout first paid and Satisfied) for and during the time She shall remain my Widow and Unmarried or Until my Youngest Child shall arrive to the Age of Twenty one years which shall first happen the better to Enable her to Support maintain and bring up my Children And in Case my said wife Goodgift shall happen to dye or Marry Again before my said youngest Child shall have attained the said Age of Twenty one years that then and in either of the said Cases first happening I give and bequeath all and Singular my said Goods Chattells personal Estate and Effects (after my said Debts and Funeral Expences are paid as aforesaid) unto my Nephew Thomas Washer the Younger of Bishopstone Yeoman and my Brother in Law John Colegate of Framfield yeoman upon Trust that they the said Thomas Washer and John Colegate and the Survivour of them his Executors and Administrators shall put and place the same out at Interest in the best manner they can and by and out of the Interest and profit thereby arising if Sufficient but if not Sufficient then by and out of so much of the principal as together with such Interest shall be Sufficient they my said Trustees and the Survivour of them his Executors and Administrators shall maintain educate and bring up my five Children William Samuel John Goodgift and Thomas Washer until the youngest of them shall arrive at the Age of Twenty one years in such manner as my said Trustees shall think fitt And that they my said Trustees and the Survivour of them his Executors Administrators or Assignes immediately after my youngest Child shall have attained the age of Twenty one years shall pay all my said Trust money which shall then remain in their hands unto and amongst all my said five Children vizt William Samuel John Goodgift and Thomas if then living (but if any be dead) to the Survivours of them equally between them Share and Share alike if more than one And if but one Survivour then all to that only Surviving Child. And in Case my youngest Child shall arive to the Age of Twenty one years before the Death of my said Wife Goodgift or her Second Marriage That then and in such Case I Give and bequeath the use only of the Summe of Two Hundred Pounds part of my personal Estate unto my said Wife for and during her Widowhood. And all the rest and residue of my said Personal Estate over and above the said Summe of Two Hundred Pounds In such Case I Give and bequeath to my said five Children (to witt William Samuel John Goodgift and Thomas) if then living but if dead to the Survivours of them equally to be divided between them Share and Share alike And as to the said Principal Summe of Two Hundred Pounds whereof I have given the use only to my said Wife for her Widowhood My Will and Mind is that immediately from and after the Death or Second Marriage of my said Wife which shall first happen the said Principal Summe of Two Hundred Pounds shall be divided and paid unto my said five Children (to witt William Samuel John Goodgift and Thomas if then living but if any be dead without Wife Husband or Child to the Survivours of them if more than one equally between them Share and Share alike and if but one such Surviviour then the whole to such only Surviving Child But my Will and mind further is that if any of my said five Children shall happen to dye before his her or their said Legacie or Legacies shall become payable leaving a Wife or Wives or a Husband or one or more Child or Children of his her or their Body or Bodies lawfully begotten that then and in such Case the Legacie and Legacies of him her or them so dying and leaving a Wife or Wives or husband or such Child or Children as aforesaid shall be paid to the Legal Representatives of such Child or Children so dying in like manner as if such Child or Children so dying had been then Living And my Will and mind further is that if any of my said five Childrens legal Representatives shall happen to be within the Age of Twenty one years at the time his her or their said Legacie or Legacies shall become payable yet notwithstanding such Minority the Receipts or Acquittances of such Minor or Minors for such Legacie or Legacies so paid to them shall be Sufficient Discharges to the Person or Persons paying the Same any Rule or Practice in Law or Equity to the Contrary thereof in any wise notwithstanding.     I have wrote and desire the same may be sent to him as soon as possible after my decease and hope it will be productive of friendship from Sir Edward to my said Nephew the said John Munn And I desire my Body may be put into a Leaden Coffin and laid in the Vault which I lately Built in Brookland Church Yard near the Church Also all the rest and residue of my Personal Estate my Just debts Legacies aforesaid funeral Expences probate of this my Will and all other Charges incident thereto being first paid and satisfied I Give and bequeath unto my said Son in Law the said Thomas Kemp and my said Nephew the said John Munn their Executors and Administrators upon Trust that they the said Thomas Kemp and John Munn and the Survivor of them and the Executors or Administrators of such Survivor do and shall as soon as Conveniently may be after my decease invest place lay out and dispose of the same from time to time on Real Securities or Parliamentary Funds but not on Personal Securities and Pay the Interest and proceeds thereof as the same shall become due unto my Daughter Ann the Wife of the said Thomas Kemp for and during the term of her natural life for her sole and own proper use and Benefit and that the receipt of my said Daughter Ann shall from time to time a good discharge for the same notwithstanding her Coverture and upon this further Trust that they the said Thomas Kemp and John Munn the Survivor of them and the Executors or Administrators of such Survivor shall and do after the decease of my said Daughter Ann pay apply and dispose of the whole principal Monies and all arrears of Interest and proceeds thereof unto and amongst all and every the Child and Children of the Body of my said Daughter Ann lawfully begotten and to be begotten equally to be divided between them if more than one share and share alike and in case any of them shall happen to be dead leaving Issue unto the Child or Children of such Child or Children which shall be then dead But the Child or Children of the deceased shall be entitled only to the share which his her or their Father or Mother would have been entitled unto if living equally to be divided amongst such Children if there be more than one share and share alike at their several and respective ages of Twenty one years or Days of Marriage which shall first happen And in case there shall be no such Child nor any issue of such child living at the time of the decease of my said Daughter Ann or in case there shall be any such Child or any issue of any such child living at the time of the decease of my said Daughter Ann and it shall happen that all of them shall die without Issue before their shares or proportions are payable that then the said Thomas Kemp and John Munn and the Survivor of them and the Executors or Administrators of such Survivor shall pay the sum of Four thousand Pounds part thereof unto my said Nephew Henry Earl his Executors or Administrators and the remaining principal Monies and all arrears of Interest and proceed thereof unto my said Nephew the said John Munn
